demint of south carolina is retiring in january. on monday south carolina gopher niki haley announced she would appoint -- governor nikki haley announced she would appoint scott, who will be the first african-american republican to serve in the senate since the 19 0's and the first black senator in the south since reconstruction. he was first elected to the u.s. house in 2010. this is about 35 minutes. >> good morning and it is a great day in south carolina. it's a historic day in south carolina, because, you know, first of all, we all were saddened and surprised when senator demint told us that he was not going to continue in the u.s. senate. but i will tell you, as i've told many people, that the heritage foundation is blessed. he will lift them up to an amazing new level. it's a foundation that i have always had great respect for, and they could not have made a more perfect pick. in this decision and process that we went through, there is no replacing jim demint, there is no replacing him. there is no one that can fill his shoes. there is no one that can really carry on that torch.

few things you should know. a 47-year-old south carolina native and a member of the house tea party caucus. after running for congress in 2010 and beating strom thurmond's son, his fact act was to overturn obama care. and scott will be the first black senator from the south since reconstruction. the first black republican senator since edward brookes of massachusetts lost the re-election bid in 1978, and the only black senator currently serving. tim scott will be the seventh black senator in the nation's history and on three occasions have african-americaning been elected to the upper chamber. only one time has a blaek senator been both elected and re-elected. the governor is aware and she sounded self-conscious about the governor reerting an eastern american. >> it is very important to me as a minority female that congressman scott earned this seat. he earned this seat for the person that he is. he earned this seat for the results that he has shown. he earned this seat for what i know he's going to do in making south carolina and making our country proud. >> right now i want to bri

appoint his successor, governor of south carolina and folks who are reading the tea leaves or the tea party leaves predict it's probably going to be representative tim scott. tim scott is perhaps best known for joining allen west in refusing to participate in the congressional black caucus and, also for suggesting impeachment of the president as he unilaterally increased the -- if heun lat unilaterally increased the debt limit. he has the backing for the club for growth. he would be the senate's only african-american member and only the g.o.p.'s second african-american senator since reconstruction. some have suggested that nikki haley, herself would run but she told a local radio station today that that wasn't even an option. here is an option that she does have. today, steven colbert tweeted, "waiting on your call nikki haley, i would like to get this wrapped up before dinner. thanks. he is from south carolina. he might be the most serious candidate out there. who knows? joining me is adam beam the political reporter for the state newspaper in south carolina via skype from columbia s

now is alan wilson, attorney general of south carolina. great to have you with us. what is your reaction to what the first lady hado sy? >> obviously, i disagree with the first lady. in every state i have looked back, more specifically georgette and indiana, one is a section five state and the other is not. when they have passed laws requiring photo id for the voter registration card, minority participation went up in subsequent elections. [talking over each other] lou: we need to make it ear to everybody that when you talk about the five states, those are states that because of civil rights transgressions, 60 years ago were 5 years ago -- they still remain under the watchful eye of the justice department for any revision in their electoral laws and procedures. is that right? >> absolutely. some states have asked the federal government's permission before they implement a law that affects elections. but in any state, minority participation actually went up in the state of georgia. over 40% in 2004 to 2008. there has t been one allegation were one court case by the federal govern
